Recreational Marijuana

For decades, Lexington residents have not been able to enjoy their marijuana strains of choice since recreational cannabis is illegal in the Bluegrass State. Since marijuana is still considered a controlled substance, there are strict laws dictating how violators are treated. Consequently, that means there are penalties for the possession, sale, and cultivation of marijuana. 

For example, if you cultivate four marijuana plants or less, that is a Class A misdemeanor. If it’s a first-time offense, you can face up to 12 months of jail time and a fine of up to $500. Now, if you have additional violations, it’s bumped up to a Class D felony and you can get hit with a maximum 5-year prison sentence. Additionally, you will have to contend with a maximum $10,000 fine.

Once you cultivate five or more plants, the state considers that an intent to sell charge. A first-time offense is a Class D felony. Subsequent offenses are classified as Class C felonies, where a person can go to prison for five to 10 years and can get fined up to $10,000.

Medical Marijuana

Over the past few years, there have been several attempts to legalize medical marijuana, but they have constantly faced pushback. In 2014, Governor Steve Beshear signed a law that legalized low-THC CBD oil for patients to use during clinical trials at the University of Kentucky. The following year, House Bill 3 and Senate Bill 40 were introduced to legalize medicinal marijuana but each failed to make it out of committee. 

A House bill in 2020 made it to the Senate, but it stalled, yet there was enthusiasm that it could pass in the future. Finally, in 2023, the state legislature passed the medical marijuana bill, and Governor Andy Beshear signed it into law. However, the bill won’t go into effect until January 1, 2025.

The new medical cannabis law establishes the medical program and sets rules for dispensaries, cultivators, and processors. The bill also establishes rules for qualifying health conditions and how patients will obtain their medical cards. While there are still a lot of question marks surrounding the bill, patients and the medical community are looking forward to the full implementation of the bill.
