Recreational Marijuana

By now, you know that recreational weed is resoundingly illegal in the state (bummer), but it’s always a good idea to know how the state got to this point. Marijuana was first prohibited in 1923, which was in line with several other states. Because of its criminalization, even small amounts of weed could lead to people serving time behind bars. Consequently, first-time offenders caught with up to four ounces of weed can face up to one year in jail and up to a $2,500 fine. Additionally, subsequent convictions can lead to stiffer sentences, including an automatic felony for two such possession cases.

Not only possessing, but selling and weed delivery are no-nos and can lead to big-time trouble with the law. For example, weed delivery of 14 grams or less is a misdemeanor that can result in up to one year in jail. On top of that, if you are caught with marijuana paraphernalia, you could lose your freedom for up to a year. 

While all of that might sound like gloom and doom, don’t be too bummed out because there have been efforts to allow adults to freely use cannabis products. As such, in 2006, cities like Eureka Springs voted to make marijuana possession a low-priority crime. Fayetteville did the same in 2008. Little Rock’s Board of Directors voted in 2021 to make weed cases a low priority.

In 2022, residents across Arkansas had recreational marijuana put in front of them in the form of a ballot initiative. Despite all the enthusiasm, ultimately, voters failed to approve it. Based on history, there’s a pretty good chance that it will appear on another ballot sometime in the future.

Medical Marijuana

Medical marijuana has fared better in Arkansas. Since there’s growing evidence of marijuana possessing therapeutic properties, many patients have long pushed for its legalization. In 2012, there was a medical cannabis initiative that residents could vote on, but they opposed it. In 2016, voters decided to give medicinal marijuana a shot and passed the Arkansas Medical Marijuana Amendment.

Per the bill, interested people would have to visit their doctor who would determine if the person has one of 12 qualifying conditions. These include hepatitis C, severe arthritis, and more. Patients register with the state and then apply for their medical marijuana card. Once you have your card, you can visit a local dispensary to purchase cannabis products like edibles, flower, tinctures, and more.

It’s important to note that you can purchase up to 2.5 ounces of marijuana every 14 days. If a dispensary isn’t nearby, you aren’t allowed to cultivate your own plants.
