All things considered, it’s not too surprising that when it comes to the legalization of recreational cannabis, Florida’s extremely conservative state government and law enforcement are both archaic and seemingly, willfully behind the times. Today’s blog will walk you through how to buy marijuana seeds in Florida while adhering to all laws and regulations.

Medical Marijuana: You Can Buy Marijuana Seeds in Florida, But…

In some ways, it’s highly impressive that this Red state with its long line of far-right governors even managed to pass the Florida Medical Marijuana Legalization Initiative, aka Amendment 2, in 2016. The passing of this amendment made it legal for those with qualifying medical conditions to apply for and purchase a Medical Marijuana Use Registry (MMUR) ID card from a state-sanctioned Medical Marijuana Treatment Center (MMTC) to be able to buy medical cannabis in Florida. However, although you can buy marijuana seeds in Florida from an online retailer, you cannot legally grow marijuana plants. The fact that Amendment 2 was passed is due to the tireless efforts of cannabis activists, who are currently working to bring about the legalization of recreational marijuana in the state.

Breaking News: Legalizing Recreational Cannabis in Florida

At this exact moment in time, growing, using, and possessing recreational marijuana is not only illegal in Florida, but penalties may include jail time, fines, and probation. Furthermore, if a person is convicted they could not only just be charged with a misdemeanor but a–Draconian– felony charge! Fortunately, starting in 2015, some Florida counties and municipalities have effectively decriminalized recreational cannabis by allowing for the issuance of a civil citation if someone is caught in possession of no more than 20 grams of marijuana. While this reform, unfortunately, does not apply statewide, it is an indicator that residents of this very conservative state are wanting to progress with the times.

In fact, on Monday, August 8, 2022, a new campaign backed by Trulieve, which is Florida’s leading medical marijuana company, filed a recreational cannabis legalization initiative known as the Smart & Safe Florida Campaign that backers are hoping will make the 2024 ballot. Back in 2021, Florida For Care, a cannabis reform group, released a survey that showed that 59% of Florida voters support legalizing recreational cannabis for adult use, and a more recent poll conducted by the University of North Florida was released in February of 2022 showing that 76% strongly or somewhat support allowing those 21+ to “legally possess small amounts of marijuana for recreational use.”

The Smart & Safe Florida Campaign

In the past, getting anything on the state’s ballot that is about legalizing cannabis for recreational use has been essentially shot down by Florida’s super conservative Supreme Court. However, Smart & Safe Florida’s committee says that they have worded this newest proposed amendment so that the Supreme Court cannot continue to hinder progress. In order to get the Smart & Safe Florida initiative on the 2024 ballot, cannabis activists will have to get the validated signatures of 900,000 registered state voters. Then, if this important reform makes it onto the ballot, 60% of Florida voters will have to vote “Yes,” which at this point, based on the surveys discussed above, seems quite doable. If Smart & Safe Florida prevails and is passed, here are just a few of the things that it does and does not entail:

  • Adults 21+ would be able to buy and possess up to 1 ounce of marijuana for personal usage, with a maximum of 5 grams for cannabis concentrates.
  • Legally growing cannabis at home is NOT included in this piece of legislation.
  • The expungement of prior records is not addressed, nor is any form of social equity
  • Medical marijuana dispensaries would be legally permitted to “acquire, cultivate, process, manufacture, sell, and distribute marijuana products and marijuana accessories to adults for personal use.”
  • The law would go into effect 6 months after being approved by state voters

As you can see, although this proposed piece of important legislation has a lot of holes in it with much room for improvement needed, just getting it onto the ballot is the first, most important step. Then, should Florida voters prove themselves to be much more progressive than their state leadership and lawmakers by voting the Smart & Safe Florida initiative into law, going after expungement, social equity, and legalizing at-home growing for both medical and recreational purposes must happen quickly and swiftly.

You do not have to spend much time watching the news to know that it is clear that Florida has a very long way to go when it comes to an ever-expanding list of items that unfairly target and punish all too many racial, gender, sexual, and class minorities just for being their true selves. So, perhaps the fact that the state has and continues to slowly take some positive steps in the right direction towards cannabis reform can serve as a form of hope, not just for bringing about the legalization of recreational marijuana, but for equity and progress in so many of this uber-conservative state’s social arenas that are currently decades behind much of the country’s actual values.
