In fact, on Monday, August 8, 2022, a new campaign backed by Trulieve, which is Florida’s leading medical marijuana company, filed a recreational cannabis legalization initiative known as the Smart & Safe Florida Campaign that backers are hoping will make the 2024 ballot. Back in 2021, Florida For Care, a cannabis reform group, released a survey that showed that 59% of Florida voters support legalizing recreational cannabis for adult use, and a more recent poll conducted by the University of North Florida was released in February of 2022 showing that 76% strongly or somewhat support allowing those 21+ to “legally possess small amounts of marijuana for recreational use.”

The Smart & Safe Florida Campaign
In the past, getting anything on the state’s ballot that is about legalizing cannabis for recreational use has been essentially shot down by Florida’s super conservative Supreme Court. However, Smart & Safe Florida’s committee says that they have worded this newest proposed amendment so that the Supreme Court cannot continue to hinder progress. In order to get the Smart & Safe Florida initiative on the 2024 ballot, cannabis activists will have to get the validated signatures of 900,000 registered state voters. Then, if this important reform makes it onto the ballot, 60% of Florida voters will have to vote “Yes,” which at this point, based on the surveys discussed above, seems quite doable. If Smart & Safe Florida prevails and is passed, here are just a few of the things that it does and does not entail:

- Legally growing cannabis at home is NOT included in this piece of legislation.
- The expungement of prior records is not addressed, nor is any form of social equity
- Medical marijuana dispensaries would be legally permitted to “acquire, cultivate, process, manufacture, sell, and distribute marijuana products and marijuana accessories to adults for personal use.”
- The law would go into effect 6 months after being approved by state voters
As you can see, although this proposed piece of important legislation has a lot of holes in it with much room for improvement needed, just getting it onto the ballot is the first, most important step. Then, should Florida voters prove themselves to be much more progressive than their state leadership and lawmakers by voting the Smart & Safe Florida initiative into law, going after expungement, social equity, and legalizing at-home growing for both medical and recreational purposes must happen quickly and swiftly.
